TERMS OF PURCHASE

In purchasing from THOMAS MAXAM STUDIO, you indicate your understanding and agreement to terms and conditions set out below.

01. Pricing

All retail prices are in Australian dollars and include Goods and Services Tax (GST) of 10%. Online prices may be subject to change without notice, and may differ from prices available elsewhere.
Wholesale prices are in Australian or New Zealand Dollars and are shown exclusive of GST (AU10% or NZ15%). This will be added on at checkout.
Please note that all international order will be processed in Australian dollars.

02. Products

While we aim to accurately display the colour and finish of products, some colours may vary slightly from those displayed by your computer monitor.

03. Payment

Payment of the Purchase Price may be made through Stripe.

In using the Purchase Services, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Payment Gateway Providers.

Following payment of the Purchase Price being confirmed by THOMAS MAXAM STUDIO, you will be issued with a receipt to confirm that the payment has been received and THOMAS MAXAM STUDIO may record your purchase details for future use.

04. Delivery & Shipping

Orders are processed Monday, Wednesday and Friday (excluding public holidays). Orders received on weekends or holidays will be processed the next business day. Delivery times for all products are 3-10 business days from the time of order unless otherwise stated. Slight delays may occur during holiday or sale period.
A dispatch confirmation email including a track and trace number will be sent once the order has been dispatched. All deliveries are made by registered courier and will require a signature.

If your order is lost or damaged in transit, please contact THOMAS MAXAM STUDIO within 24 hours of receiving your order. Inspection of all products is required on delivery. Any damage must be noted on the delivery docket presented to you. We will not be responsible for any damage unless we are notified within the time period specified.

THOMAS MAXAM STUDIO does not provide the Delivery Services to you and you agree that THOMAS MAXAM STUDIO will not be liable to you for any special, indirect or consequential loss or damage, loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Delivery.

05. Cancelations

Once your order has been confirmed any cancellation request must be sent in writing. Cancellations will incur charges which vary dependant on the status of production and how far the order has progressed. A minimum of 30% of order value will be payable on cancelations in addition to costs incurred by THOMAS MAXAM STUDIO relating to supplying your order.

06. Returns & Refunds

All purchases are final. All THOMAS MAXAM STUDIO products are carefully inspected before shipment or collection. Customers should similarly inspect all items at the time of delivery.
THOMAS MAXAM STUDIO may, at their sole discretion, provide an exchange or refund on the return of the Products within 10 days where the Product packaging is unopened and remains in a saleable condition. You acknowledge and agree that you are liable for any postage and shipping costs associated with any exchange/refund pursuant to this clause.

07. Damages and limitations

THOMAS MAXAM STUDIO will not accept claims for:
- Damage resulting from storage by the customer or by THOMAS MAXAM STUDIO on behalf of the customer.
 - Damage resulting from accident, alteration or misuse after delivery.
 - Dissatisfaction with products because of natural variations over which THOMAS MAXAM STUDIO has no control.
Material irregularities of bubbles in glass, natural patina and oxidisation since such marks and textures are the evidence of hand crafting and considered a product feature.

08. Intellectual property

Unless otherwise noted, all materials on this website are protected as the copyright, trademarks and/or other intellectual properties owned by THOMAS MAXAM STUDIO.

Who are you? Your privacy is important to us.

THOMAS MAXAM STUDIO believes that the responsible use of personal information collected on its website is critical to its business objectives and reputation. As part of our commitment to privacy, we have adopted this Online Privacy Statement.

01. Information Collected

When you visit our website our Internet Service Provider makes a record of your visit and logs the following information for statistical purposes;

• your server address

• your top level domain name (for example .com, .gov, .au, .uk etc.)

• the date and time of your visit to the site

• the pages you accessed and documents downloaded

• the previous site you have visited

02. Cookies

THOMAS MAXAM STUDIO website only uses session cookies and only during a search query of the website. Our Internet Service Provider has assured us that no cookies are employed on this website except for those associated with the shopping basket. The website statistics for this site are generated from the web logs as outlined above.
Upon closing your browser the only cookie information stored is an id number relating to your shopping basket so that upon your next visit the shopping basket will still contain your books. This information is kept for 30 days and is then removed.

03. Access to Information Collected

THOMAS MAXAM STUDIO will not make any attempt to identify users or their browsing activities. However, in the unlikely event of an investigation, a law enforcement agency, or other government agency, may exercise its legal authority to inspect our Internet Service Provider’s logs.

04. Use of Information Collected

We will only record your email address if you send us a message. Your email address will only be used for the purposes for which you have provided it and it will not be added to a mailing list or used for any other purpose without your consent.
THOMAS MAXAM STUDIO website does not provide facilities for the secure transmission of information across the Internet.
Personal information provided by you will be retained only for as long as necessary to fulfil the purposes for which the information was collected or as required by law.
